KNOWSLEY METROPOLITAN BOROUGH COUNCIL (PROHIBITION AND RESTRICTION OF WAITING AND LOADING AND PARKING PLACES) (CIVIL ENFORCEMENT AND CONSOLIDATION) ORDER 2015 (EXPERIMENTAL AMENDMENT NO 50) (LEYLAND

NOTICE IS GIVEN that Knowsley Metropolitan Borough Council made the above-named order (“the Order”) on 23rd October 2019 under Sections 1, 2, 4, 9, 10, 19, 32, 35, 45, 46, 47 53 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (“the 1984 Act”). The effect of the Order is to amend the Knowsley Metropolitan Borough Council (Prohibition and Restriction of Waiting and Loading and Parking Places) (Civil Enforcement and Consolidation) Order 2015 as amended (“the 2015 Order”) by introducing the following changes:-

Loading Only

A loading only area from Monday to Saturday from 8am to 6pm on Leyland Street Prescot from its junction with High Street, in a southerly direction, for a distance of 56 metres; and

Prohibition on loading, unloading or waiting

A prohibition on loading, unloading or waiting at any time on Hill Street Prescot for its entire length.

The 2015 Order has been amended by the revocation of the Map Tiles specified in the First Schedule to this notice and by the insertion of the Map Tiles specified in the Second Schedule to this notice. The Order comes in to force of the date that the Council publishes a notice stating that the Order has been made.

A copy of the Order, Map Tiles and plans and a statement of the Council’s reasons for making the Order  may be inspected free of charge during normal office hours Monday to Friday (excluding bank holidays and public holidays) at the reception desks at the Council’s One Stop Shop offices at The Halewood Centre, Roseheath Drive, Halewood, L26 9UH, The Prescot Centre, Prescot Shopping Centre, Aspinall Street, L34 5GA, Archway Road, Huyton, L36 9YU and The Kirkby Centre, Norwich Way, Kirkby, L32 8XY.

If you wish to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the 1984 Act, or that any requirement of the 1984 Act or of any instrument made under the 1984 Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for that purpose to the High Court.

When the Order comes into force the effect will be to amend the Knowsley Metropolitan Borough Council (Prohibition and Restriction of Waiting and Loading and Parking Places) (Civil Enforcement and Consolidation) Order 2015 as amended (“the 2015 Order”) by introducing the following changes on an experimental basis –

Loading Only 

A loading only area from Monday to Saturday from 8am to 6pm on Leyland Street Prescot from its junction with High Street, in a southerly direction, for a distance of 56 metres; and

Prohibition of loading, unloading and waiting

A prohibition of loading, unloading and waiting at any time on Hill Street Prescot for its entire length.

The effect of the Order is to amend the 2015 Order by the temporary suspension of the Map schedules specified in the First Schedule to this Order for the duration of the Order and the insertion and addition of the Map Schedules specified in the Second Schedule to this Order for the duration of the Order.

A copy of the Order, Map Tiles, plans showing the parts of the highway and areas affected by the Order and a statement of the Council's reasons for proposing to make the Order may be inspected free of charge during normal office hours Monday to Friday (excluding bank holidays and public holidays) at the reception desks at the Council’s One Stop Shop offices at The Halewood Centre, Roseheath Drive, Halewood, L26 9UH, The Prescot Centre, Prescot Shopping Centre, Aspinall Street, L34 5GA, Municipal Buildings, Archway Road, Huyton, L36 9YU and The Kirkby Centre, Norwich Way, Kirkby, L32 8XY.

This Order shall continue in force for a period not exceeding 18 months and the Council will be considering in due course whether the provisions of the Order should be continued in force indefinitely.

Within a period of 6 months beginning with the day on which the experimental Order came into force, or if the Order is varied by another order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force any person may object to the making of an order for the purpose of such indefinite continuation. Any such objection must be in writing, state the grounds on which it is made and be sent to Mike Dearing Head of Legal Services, Knowsley Metropolitan Borough Council, Legal Services, 2nd Floor, Municipal Building, Archway Road Huyton Merseyside L36 9YU quoting reference (Legal/YH/Leyland TRO) within the 6 month period.
